GSP makes arrest in fatal Saturday night hit-and-run that killed bicyclist

An arrest has been made in a Saturday night hit-and-run that killed 59-year-old Richard Miley, who was riding his bicycle on Vineyard Road when he was struck.

Benjamin Tyshawn Akins, age 46, is now in custody and charged in Miley’s death.

“The Georgia State Patrol arrested him,” said Maj. Dwayne Jones, of the Spalding County Sheriff’s Office. “He’s been charged with DUI, leaving the scene of an accident and vehicular homicide.”

SCSO personnel located Miley’s body in a ditch on Vineyard Road just before midnight Saturday.

Troopers from the Georgia State Patrol-Griffin Post also responded to the scene, and the GSP Specialized Collision Reconstruction Team investigated the incident.

Spalding County Coroner Michael Pryor pronounced Miley deceased at the scene.

“He had lights on his bicycle, and he was wearing a high-visibility vest on top of his coat. He was doing everything he could possibly do to keep from getting hit, but someone hits him, anyway,” Pryor said in a Sunday interview. “There’s no way possible this person could say they didn’t know they hit an individual. You hear people sometimes say they thought they hit a dog, but in this case, there’s no way they didn’t know they’d hit a person.

Akins is being held in the Spalding County Jail.
