GPD investigating “criminal” death in Grandview Apartment complex

GPD: Two dead in Saturday murder/suicide

The Griffin Police Department is investigating what officials are describing as a murder suicide.

Officers at approximately 2:05 p.m. Saturday responded to a call requesting a welfare check at 704 Grandview Drive Apartment F4.

Upon arrival, officers of the Uniform Patrol Division were unable to contact anyone at that residence.

After being notified the back door was unlocked and based on information provided by the original complainant, officers entered the residence.

Once inside, officers located the bodies of two deceased individuals who have been identified as 35-year-old Ashley Smith, of Peachtree City, and 36-year-old Darcell Goggins, of Griffin.

The scene was secured, and the Criminal Investigation Division was notified.
Investigators obtained a search warrant for the apartment and have conducted interviews with multiple family members, friends and neighbors.

The crime scene was processed by GPD crime scene investigators and other CID investigators. Officials say multiple pieces of evidence will be submitted to the Georgia Bureau of Investigation Crime Lab.

Authorities say investigators believe Goggins shot Smith and then took his own life.

The investigation is ongoing and active.

One person critically wounded in Friday night shooting

Personnel of the Griffin Police Department on Friday night responded to the shooting in Walden Pointe Apartments.

Authorities say the injured party was subsequently transported by air for treatment in an Atlanta trauma unit.

Victim in Friday night shooting in Griffin’s Walden Pointe Apartments has died

The victim in an overnight shooting in Walden Pointe Apartments on Carver Road in Griffin has died.

Griffin Police Department Chief Mike Yates confirmed Saturday morning that his agency’s investigation of this murder is active and ongoing.

No suspects are in custody at the time of this report.

Authorities identify Friday night shooting victim

The victim of a Friday night homicide has been identified as 26-year-old Jeffery Ryan Deluca.

Officers of the Griffin Police Department Uniform Patrol Division responded at 11:18 p.m. Friday to a call reporting a person shot in Apartment 1-37 of the Walden Pointe Apartments located at 700 Carver Road.

Upon arrival, Deluca was located in the doorway of that apartment unit.

Deluca had sustained a single gunshot wound to the head.

WellStar Spalding Regional Hospital Emergency Medical Services responded and rendered aid. Deluca was subsequently transported by helicopter to an Atlanta trauma unit where he later died.

Investigators of the GPD Criminal Investigation Division are continuing to work this case, following leads and conducting interviews.

Second Friday night shooting in Spalding wounded one and caused wreck with injuries

A man was seriously wounded Friday night in Spalding County when he was shot while travelling in a vehicle. A second man also sustained grievous injuries in a subsequent wreck.

Authorities say the shooting occurred after midnight, when the wreck, which was unrelated to the shooting incident, was reported.

“We responded about 12:24 a.m. to Old Atlanta Road and Birdie Road to a report of an accident with injuries. When the deputies arrived, they determined one of the passengers was suffering from a gunshot wound,” said Maj. Dwayne Jones, of the Spalding County Sheriff’s Office. “The driver of the vehicle appeared to have injuries, as well, with a broken leg. So, GSP was called to work the wreck and our investigators were called to the scene to work the shooting.”

Both the driver of the vehicle who suffered a broken leg and the passenger who was shot are males. Their names are being withheld at this time.

The shooter has also been identified as a male.

“Both of the victims were in pretty bad shape,” Jones said.

The shooting victim sustained what appeared to be a single gunshot wound to the chest and the driver appeared to have suffered a compound fracture of the leg.

Both men were transported to the trauma unit of a local Atlanta hospital with nonlife-threatening injuries. The shooting victim was transported by air ambulance and the wreck victim was transported by ambulance.

Officials have not released how many shots they believe may have been fired but said it was multiple.

“Several shots were fired at the Honda.  Obviously, one hit the passenger, but I don’t have the amount of shots – other than one – that potentially struck the vehicle. We know that one obviously struck the passenger in the Honda Accord,” Jones said.

The investigation remains active, but authorities have said the shooting followed a dispute at a local party.

“They had been to some type of party on Old Atlanta Road. They became involved in an altercation with some other males there at the party. As they were leaving the party, a male subject started firing shots at the Honda Accord as it was leaving the party and travelling along Old Atlanta Road. The driver, as he was fleeing the scene, that’s when the accident occurred, when the Honda Accord struck a truck,” Jones explained. “The investigation shifted from an accident to a shooting incident.”

The location of the party is not yet being released, but it was in the vicinity of the wreck.

GPD: Three suspects arrested, charged in Friday night murder

Three suspects are in custody, charged in the Friday night murder of 26-year-old Jeffery Ryan Deluca.

Deluca died early Saturday after being transported by helicopter to an Atlanta trauma unit for treatment of a gunshot wound to the head.

According to the Griffin Police Department, leads developed by investigators, tips, witness interviews and the execution of search warrants concluded that Deluca’s murder resulted from a “failed drug transaction.”

Arrested were 21-year-old Xavier Lamar Carter, of Barnesville, 20-year-old Ryan Willis, of Jonesboro and 17-year-old Damarion Sinkfield, of Griffin.

All three suspects have been charged with murder, armed robbery and aggravated assault.

This investigation is ongoing, and authorities say additional charges are expected.

Two GPD officers injured, one seriously, in early Tuesday morning wreck

Two Griffin police officers were injured, one seriously, in a wreck early Tuesday morning when the patrol car occupied by Officer Amanda Frix, a Griffin Police Department veteran, and Erin McAdams, a recently-certified rookie officer who was in field training under Frix’s supervision, was struck in the driver’s side.

The incident occurred at approximately 5:30 a.m. at the intersection of Georgia Highway 16 and Hammond Drive.

According to the GPD, the preliminary investigation indicates a commercial vehicle traveling west at that intersection ran a red light a struck the officers’ patrol car, continued west and overturned.

Frix was transported by helicopter to the trauma unit of Atlanta Medical Center with serious injuries.

McAdams sustained non life-threatening injuries and was transported by ambulance to WellStar Spalding Regional Hospital.

GPD Chief Mike Yates later reported that McAdams was treated and released, and that Frix is in stable condition.

The Georgia State Patrol-Griffin Post is investigating the wreck, but Cpl. R. Youngblood reported no information was available at the time of publication.

The GPD asks the community to keep both officers in their prayers with the hope of full and speedy recoveries.

Teen girl charged in Griffin Skate Inn incident; BLM protest underway at SCSO

A protest in support of the Black Lives Matter movement is underway at the Spalding County Sheriff’s Office.

Organized by community activist Ray Harps-Muhammad, the protest is in response to an incident that occurred Friday night at Griffin Skate Inn.

The family of a 14-year-old girl alleges she was slapped in the face by 63-year-old Tommy Scott, a Griffin Skate Inn security guard, after the teen admittedly slapped his cell phone from his hand.

According to the incident report filed by SCSO Deputy D.J. Porter, Scott provided a cell phone recording that depicted the juvenile approaching him and saying, “I don’t give a f*ck about you recording,” before she slapped his hand, causing him to drop his cell phone.

Porter alleges the juvenile female “appeared to be the primary aggressor in three incidents,” including one in which she allegedly spat on 52-year-old Bill Weatherup, the owner of Griffin Skate Inn, and another in which she reportedly threw a rock that broke the windshield of a van.

Porter stated the juvenile said she threw the rock after occupants of the van first threw objects at her.

The juvenile’s statement was supported by Tomeka Wiems, her aunt, who said she also witnessed Scott slap her niece.

A second Griffin Skate Inn security guard, Taylor Hamm, told authorities he had repeatedly instructed the individuals in the van to leave, but they refused to do so and instead, kept getting out of the van due to an altercation that allegedly occurred inside the skating rink.

Mary Morgan, the van’s driver, disputed those allegations, saying she was attempting to leave when the other group  of juveniles began throwing things at her vehicle.

Muhammad said the Tuesday morning protest was organized in response to Scott having not being arrested.

“All we’re trying to do in this case here is first of all come to some resolution. Did Tommy Scott put his hands on a 14-year-old girl? Regardless of what she said, regardless of what she did, no one has a right to put his or her hands on a child,” Harps-Muhammad said. “We’ve already asked the Sheriff to come to some type of resolution. On Sunday, we gave him 24 hours, and no action has been taken. Tommy Scott was allowed to go home while the girl who was interviewed, it was more of an antagonistic interview with her.”

Harps-Muhammad said he believes the everyone involved should be held responsible for their actions.

“I think he slapped her across the face after she slapped the phone out of his hand. By her own word, she admitted that she slapped the phone out of his hand. He retaliated with the phone being slapped out of his hand – according to her word and her family’s word – he retaliated with a slap to the face. We just want justice in this,” he said. “If it proves that she lied, then we’ll deal with that, as well, but I don’t think she lied. I don’t think the mark on her face indicates she lied. I don’t think her family lied.”

The 14-year-old, whose name has not been officially released, has been criminally charged in the incident.

“At this point, the only person who has been charged is the juvenile,” SCSO Maj. Dwayne Jones said Tuesday, referring to Porter having filed a juvenile complaint against the teen girl. “It’s considered an arrest.”

She is facing two charges – simple battery and criminal trespassing – but the investigation is ongoing.

“The deputy (Porter) made a determination based on the information he had, but in case there is additional information that we should review, we have asked anyone who witnessed it or may have cell phone recording to please contact Lt. James Cape of our CID (Criminal Investigation Division),” Jones said. “We’re not second-guessing the actions of the deputy. We’re just ensuring that we’ve obtained all the evidence that’s associated with the disturbance.”

Jones said the Sheriff’s Office was not notified about the protest, but they were aware it had been planned.

“We hope that it’s going to be a peaceful protest, but that’s what we understand,” Jones said. “People can exercise their First Amendment rights.”

Upon learning the juvenile has been charged in this incident, Harps-Muhammad said, “It’s interesting that they can charge her so quickly but can’t seem to find the evidence to charge him.”

GSP: Driver was distracted by cell phone when box truck struck GPD patrol car

Griffin Police Department Officer Amanda Frix and Officer Erin McAdams continue to recover from injuries sustained when their patrol car was struck by a commercial truck.

According to Sgt. 1st Class K.J. Searcy, of the Georgia State Patrol-Griffin Post, the wreck, which occurred at approximately 5:30 a.m. Monday, was caused by a distracted driver.

“It appears that the box truck failed to stop for the red light and travelled through the intersection. The police car, which had a green light, was traveling through the intersection at the same time and the box truck struck the police car on the driver’s side,” Searcy said.

Searcy said the commercial vehicle a Ford Super Duty – an Aramark delivery box truck – was driven by 26-year-old Gregory Blake Bell, of Hampton. Authorities say he sustained minor injuries when his vehicle overturned after the collision.

Bell was cited with failure to obey traffic control device and he was also given a warning for distracted driving, failure to exercise due regard.

When asked the basis of the distracted driving charge, Searcy said, “He (Bell) stated that he was actually reaching down for his phone.”

Speed was not considered a contributing factor.

Frix was seriously injured in the incident and was transported by air ambulance to the Atlanta Medical Center trauma unit. McAdams sustained minor injuries and was treated and released from WellStar Spalding Regional Hospital.

SCSO deputy ends Thursday night vehicle pursuit with execution of PIT maneuver

A vehicle pursuit Thursday night involving the Spalding County Sheriff’s Office ended in Lamar County at approximately 7:20 p.m. when a deputy performed a PIT maneuver.

Maj. Dwayne Jones said the pursuit began when another deputy attempted to execute a traffic stop.

“Deputies noticed a vehicle driving extremely erratically and reckless in the area of the railroad tracks of Johnson and Macon roads. They went to initiate a traffic stop and the vehicle fled the scene. The vehicle traveled on County Line Road of course to the bypass and turned towards the direction of Barnesville,” Jones said. “An off-duty deputy who was on his way home and in a marked car joined the pursuit. Due to the erratic nature of her driving – the driver was a woman – a PIT maneuver was performed. He’s actually certified in performing the PIT maneuver and was able to execute that successfully.”

Jones said no one was injured and only slight damage to the driver’s vehicle resulted from the incident.

“It just shows our deputy’s awareness. Even though Deputy Jacob Strock was on his way home, he was nearby, he heard the call on the radio and he responded to the scene. He was able to engage the driver and engage a successful pit maneuver which terminated the pursuit without injuries to any of the parties involved, which is what we want,” Jones said.

Authorities say the driver will face numerous traffic charges.

SCSO: Driver in Thursday night vehicle pursuit was driving under the influence

The Spalding County Sheriff’s Office has identified the woman who allegedly fled from deputies Thursday night, resulting in a three-county vehicle pursuit as 26-year-old Tori Markia Parker.

Authorities allege Parker was driving under the influence when she refused to comply when deputies initially attempted to conduct a traffic stop in the area of Johnson and Macon roads in Spalding County.

Deputies say they first noticed her driving “extremely erratically,” said SCSO Maj. Dwayne Jones.

Parker then allegedly fled, travelling on County Line Road to the bypass before turning towards Barnesville.

SCSO Deputy Jacob Strock, who was off-duty and en route home when the incident began, ended the pursuit with the successful execution of a PIT maneuver.

Parker was arrested and charged with fleeing/attempting to elude, obstruction of a law enforcement officer, failure to stop or yield at a stop sign, reckless driving, driving without proof of insurance, no seat belt, three counts of failure to maintain a lane and driving under the influence/less safe.

Three people injured in head-on collision

Three people were injured in a head-on collision Friday evening at the intersection of Highway 16 and High Falls Road.

According to Sgt. Robert Thompson, of the Georgia State Patrol-Griffin Post, the wreck resulted from distracted driving.

“One driver was distracted and ran the red light at 16 and struck one that was crossing the intersection. In turn, the vehicle went over and struck the control box for the red light and caught on fire,” Thompson said.

Rachel Hughes, age 33, of Clairmont, Fla., who was driving a 2017 Jeep Latitude, was cited with failure to obey a traffic control device in the incident.

Takiyah Gregory, age 29, of Marianna, Fla., who authorities say had the right of way when her 2009 Hyundai Sonata was struck in the intersection was transported to the emergency room of WellStar Spalding Regional Hospital (WSRH). Hughes and a passenger in her vehicle were also transported by ambulance to WSRH for treatment.

Federal judge recommends dismissal of Hawbaker lawsuit against Sheriff and jail administration

Don Hawbaker, the Spalding County commissioner who has been held without bond in the Spalding County Jail since his Feb. 4, 2020 arrest, has filed a lawsuit against Spalding County Sheriff Darrell Dix, Maj. Robert Sowell and Capt. Kyle Phillips. Sowell is the jail administrator and Phillips is the assistant jail administrator.

In a Prisoner Civil Rights Complaint filed July 2 in the U.S. District Court for the Northern District of Georgia, Hawbaker contends he has been denied his 6th Amendment right to effective legal counsel.

Hawbaker alleges that Dix, Sowell and Phillips have since March 15 denied him “contact access” with his criminal defense attorney, Lee Sexton.

“Although Defendants purport to make ‘access’ available via telephone and email, plaintiff has no assurance – none – that communication with his counsel is not recorded, not monitored or otherwise not accessed by Defendants, the prosecutor (Elizabeth Presley) or other jail personnel, infringing upon Plaintiff’s attorney-client privileged communication protections,” Hawbaker said, who further contends that this has “in all reasonable likelihood caused Plaintiff to be held, without bail, in jail for many additional days than he otherwise would have been held.”

Hawbaker further contends “there is no ‘pandemic’ exception to Plaintiff’s constitutional rights.”

With regard to damages he attributes to “loss of liberty,” Hawbaker seeks compensation of $1 million per day since March 13, or alternatively since April 16 – although the significance of the second date was not specified – through the date of his release from pretrial detention.

He seeks $100 million in punitive damages individually from Dix, whom he claims has, in particular, “infringed upon his rights maliciously, publicly and with personal hostility not displayed towards other inmates or alleged criminals.”
As evidence of this allegation against Dix, Hawbaker cited a Feb. 19 letter the Sheriff submitted to Governor Brian Kemp.

In that letter, in which Dix requested Kemp immediately remove Hawbaker from office as the Spalding County Board of Commissioners District 5 representative, the Sheriff described Hawbaker as “a threat to the community,” “a menace to society” and said his actions “are worse than the actions of a gang member.”

Dix went on to say, “I am asking that you, in your capacity as Governor of the great state of Georgia, take steps to remove Donald Hawbaker from his position as a Spalding County Commissioner as soon as possible. He has violated the trust of the people and violated the law in the most egregious ways imaginable.”

Statutorily, Kemp cannot initiate the process that could result in Hawbaker’s removal from office prior to an indictment by a grand jury, which still has not occurred.

Dix adamantly denies all aspects of the complaint, including the allegation that he has behaved with personal hostility towards Hawbaker.

“I can’t comment on pending litigation other than to say he’s just like any other inmate and he’s doing what inmates do,” Dix said. “I can say he’s not treated any differently than any other inmate in our jail.”
When asked if that means no Spalding County Jail prisoners have been permitted in-person contact with legal counsel, Dix said, “Right, right, but we do have mechanisms in place where they are allowed to meet with their attorneys via video and other means any time they want to.”
He then denied monitoring those inmate-attorney communications.

“No, they are not. The communications between inmates and their legal counsel are not monitored. They are exempt from being monitored and are confidential.”

Hawbaker said he also anticipates filing an amended complaint for a separate claim alleging he has been deprived access to the courts.

Prior to filing this Prisoner Civil Rights Complaint, he first sought relief through an internal grievance process that according to Hawbaker was denied.

United States Magistrate Judge Russell G. Vineyard on July 28 recommended Hawbaker’s suit be dismissed for failure to state a claim.

Vineyard stated in part, “However, plaintiff has ‘shown neither irreparable harm nor prejudice’ from the suspension of in-person visits with counsel.’”

He went on the cite case law – United States v. Dawara – stating, “that the suspension of in-person legal visits was a reasonable measure necessary to prevent the spread of COVID-19 and that pretrial detainee’s ‘inability to meet with his attorney in person [did] not unreasonable burden his access to counsel’ or amount ‘to a constitutional violation.’”

Hawbaker is accused of simple assault under the Georgia Family Violence Act related to an incident involving his wife, Gayle Hawbaker, three counts of disorderly conduct pertaining to alleged cursing during phone conversations with Spalding County Sheriff’s Office employees and four counts of aggravated assault against a law enforcement officer.

Mother applies for arrest warrant against Griffin Skate Inn security guard

Monica Evans, the mother of a 14-year-old girl involved in recent dispute at Griffin Skate Inn, has submitted a criminal warrant application in Spalding County Magistrate Court seeking an arrest warrant for simple battery against 63-year-old Tommy Scott.

Scott, a former security guard at Griffin Skate Inn, is accused of slapping the 14-year-old girl across the face after she admittedly struck his hand, knocking his cell phone to the ground.

“I got a call from my daughter (name redacted) stating that the security guard had slap her to the ground that works at the Griffin Skate Inn. She stated that she hit the phone out of his hands and then he slap her. Witness stated that the person indeed slap her (sic all),” Evans stated in her warrant application.

Evans warrant application was signed by Magistrate Judge Sam Parks.

The incident report filed by Spalding County Sheriff’s Office Deputy D.J. Porter cited a cell phone video recording Scott produced that depicted the juvenile girl approaching him and saying, “I don’t give a f*ck about you recording,” before she slapping his hand.

Porter additionally stated the 14-year-old girl “appeared to be the primary aggressor in three incidents”  July 24 at Griffin Skate Inn, including one in which she allegedly spat on the skating rink owner, 52-year-old Bill Weatherup, and another in which she allegedly threw a rock, breaking a van window.

Porter said the juvenile said she threw the rock after the van’s occupants first threw objects at her.

The teen girl has been criminally charged in the incident. She is facing charges of simple battery and criminal trespassing.

Maj. Dwayne Jones on Thursday confirmed the SCSO investigation of this incident is ongoing.

“It would be premature to say at this point if she’s going to be facing additional charges, but we are looking into the totality of the incident,” Jones said. “We haven’t made a determination if any additional charges or any other person is going to be charged in the incident.”

The Magistrate Court hearing will be held at 1 p.m. Aug. 11 to determine if a criminal arrest warrant will be issued against Scott.
Griffin Skate Inn has been closed and the property is listed for sale.

Griffin Fire-Rescue firefighter arrested by Meriwether County Sheriff’s Office

A Griffin Fire-Rescue (GFR) firefighter has been arrested by the Meriwether County Sheriff’s Office (MCSO).

According to a press release issued by the city of Griffin after the close of business Thursday, the Griffin Police Department on Tuesday notified GFR that a warrant had been issued for the arrest of Kevin Burkholder.

Authorities say Burkholder was transported to the Griffin Police Department, where he was held until the Meriwether County Sheriff’s Office took him into custody.

Burkholder has been placed on administrative leave without pay.

The GRIP will report additional information as it becomes available.

Griffin firefighter arrested on multiple child sexual abuse charges

Griffin Fire-Rescue Firefighter Kevin Burkholder has been arrested on ten charges including multiple counts related to the sexual abuse of a child.

According to the Meriwether County Sheriff’s Office, Burkholder is being held on one count of incest, one count of aggravated child molestation, one count of felony sodomy, one count of child molestation, two counts of felony sexual exploitation of children and four counts of unlawful eavesdropping or surveillance.

The arrest warrant, which was issued Aug. 4, cited one incident alleging Burkholder committed the felony of child molestation “when he placed his fingers, mouth and penis on the vagina” of a minor child.

The nine additional charges were brought after the initial arrest warrant was issued.

Burkholder was taken into custody Tuesday evening by the Griffin Police Department.

GPD Chief Mike Yates said his agency was notified by the Meriwether County Sheriff’s Office that an active warrant had been obtained for Burkholder’s arrest.

Yates said he was taken into custody without incident. Burkholder was transported to the Griffin Police Department, where he was held until the Meriwether County Sheriff’s Office took him into custody.

Burkholder has been placed on administrative leave without pay.

GSCSS awarded $10,000 grant for literacy

All Griffin-Spalding County ninth-grade students, as well as all A.Z. Kelsey Academy students, will be receiving two books as part of a Community Foundation for Greater Atlanta initiative.

The Griffin-Spalding County School System (GSCSS) was selected to receive this $10,000 grant from over 300 grant proposals.

This grant will fund the Free Reading Enrichment for Students at Home, or FRESH program, supports the independent reading portion of the Balanced Literacy program.

Students will select two books from more than 60 being offered. Those choices can be found at https://gscsela.libib.com/i/gscsfresh.

Participating students will be asked to use Notice and Note analytical questions to write responses to the books and will have an opportunity for online discussion space through Instagram and Google Classroom.

“We realize that the pandemic has decreased access to books for students and very few free resources exist for teens to read beyond social media. So, we’re grateful for this generous donation and investment in our students’ rich and diverse literacy experiences,” said GSCSS K-12 English Language Arts Curriculum Coordinator Shervette Miller-Payton.

Students will pick up their books at their school on designated dates during the week of Aug. 10-14.

Spalding County S.O. narcotics agent has resigned following GBI investigation

Josh Pitts, who served as the lieutenant of the Spalding County Sheriff’s Office Special Operations Unit, has resigned following an investigation conducted by the Georgia Bureau of Investigation (GBI).

Sheriff Darrell Dix confirmed that Pitt’s resignation preempted what would have been strong disciplinary action against the former narcotics agent.

The GRIP had learned that Dix intended to demote Pitts from the rank of lieutenant to that of entry level deputy. When asked if that information regarding the disciplinary action Dix had intended to take was accurate, the Sheriff stated, “Yes, among other things.”

Dix later added, “If he had stayed, there would have been disciplinary action taken against him that was pretty severe.”

The GBI investigative report was released to Dix Friday, Aug. 7, and he was in the process of reviewing the case file when Pitts resigned effective immediately.

Dix requested the GBI investigation after receiving information alleging wrongdoing following May 20 arrest of Anthony Smith, who the SCSO alleges is a gang member.

Smith himself did not file an immediate complaint. Instead, the initial report was made by his mother.

According to Dix, she called within hours of her son’s arrest and said he had been physically assaulted on the side of the road while in custody and en route to the Spalding County Jail.

“I came unglued. I think that that is an understatement. I don’t know if I’ve ever been madder than that in my whole life and I’ve been pretty mad,” Dix said.

After confirming the patrol unit transporting Smith to the jail had stopped, Dix immediately requested the GBI investigate the allegation.

“The reason that I didn’t immediately launch an internal  investigation is because the incident may have been criminal in nature, so when I learned about the allegation, I contacted the GBI. Within two hours of me learning about the incident, there was a GBI agent sitting in front of me discussing it,” Dix said. “When there’s a criminal investigation going, you don’t start an internal investigation. You let the criminal investigation run its course and then you determine if policies were violated and that sort of nature,” he explained. “Especially when you contact the GBI. They want to speak to witnesses and so forth before anyone speaks to any other investigators.”

Dix said he opted for a GBI investigation to avoid the appearance of impropriety.

“I didn’t want anything said that it was us not doing what were supposed to do. That’s why we contacted them immediately. It wasn’t an issue of letting it sit and stew for days. This (incident) was not good,” Dix said.

Ultimately, it was determined that Josh Pitts will not be prosecuted.

“I, along with several attorneys in my office, have reviewed the case file numbered 02-0226-14-20 involving a complaint made by Anthony Smith. Thank you for your thorough investigation into the matter. Upon review, there is not probable cause to support any criminal charge. This would conclude my office’s involvement,” said Griffin Judicial Circuit District Attorney Marie Broder wrote in a letter to GBI Agent Adam Thompson.

“The letter from the DA’s office was that there was not probable cause for any criminal charges, but there were policies that were violated. I do know that. That was my determination. I was actually in the middle of reading the investigation so I could make the determination of what I was going to do when he resigned,” Dix said. “I was in the middle of that and Josh turned in his resignation, so it was not a resignation while under investigation because I had not begun an internal. I had not even finished reading the GBI report yet.”

Because the GBI investigation had concluded and Dix had not yet initiated an internal investigation, Pitts’ resignation was considered voluntary and will thus not trigger a subsequent investigation by the Georgia Peace Officers Safety and Training Council, the governing body that issues and oversees law enforcement officer certification statewide.

Despite the determination probable cause did not exist for criminal prosecution, Dix said policy violations were clear.

“I do know that he (Pitts) called the officer that was driving the car (Deputy Conner Dix) and told the officer to stop. The officer that was driving the car stopped and never got out of their car. There was a verbal altercation that happened between Josh and Anthony Smith. There was physical contact between Smith and Josh,” Sheriff Dix said. “Josh said that it was non-aggressive, that he touched him on the shoulder because the guy was upset. Smith said that Josh pushed him into the partition, the black plastic partition.”

Asked if forensic tests were conducted to determine if Smith’s head made physical contact with the vehicle’s partition, Dix said the vehicle had been swabbed, but any results would not determine what happened.

“There was one account where when Josh reached up and put his hand on his (Smith’s) shoulder, he snatched his head away and smacked it into the screen. Josh said he was trying to deescalate the situation. It’s one of those things that there’s no denial his head went into the screen, but there’s no way of knowing if he jerked away and hit his head into the screen or was pushed into the screen. I don’t think there’s any doubt that he his head hit it,” Dix said. “I think we know what happened up to a certain point. It’s after that there is a split and again, that’s why I contacted the GBI immediately and didn’t interfere. Other than giving statements, no one in my agency had anything to do with it. I didn’t want anyone to be able to say my agency influenced the investigation. It was right down the line exactly.”

Dix explained what led up to Smith’s arrest and the incident that launched the GBI investigation.

“This guy (Anthony Smith) a couple of days before this made a Facebook post. He’s a known gang member. He’s a member of the Blixy gang. They’re extremely violent. They have a propensity to shoot at people. A couple of days before this happened, he had posted a couple of photos of himself with guns and had called the Sheriff’s Office out and had called Josh (Pitts) out and had used some racial terms to call Josh out. We found him (Smith) in a store in The Flats and took him into custody and took a gun that looked like one from his post on social media. During his arrest, it was a regular arrest. There was no use of force. Nothing. Josh was not at the scene of the arrest. He was actually eating lunch and heard the arrest on the radio,” Dix said. “He (Pitts) called the transporting officer and told him to stop near the UGA-Griffin Campus on Experiment Street and he pulled up behind the vehicle in his car, got out, walked up to the transporting officer’s car, opened the door and that’s when the incident occurred. It was on Experiment Street. He didn’t ask him to pull off behind a building or anything. Josh and Smith both say that Josh opened up the door and there was a verbal altercation. Josh told Smith to keep his name out of his ‘effing mouth.’ They argued with each other. At that point, that’s when the physical contact was made with putting his hand on his shoulder. Josh said he did it to deescalate, like he was saying, ‘Come on, man.’ Smith said he grabbed him by the shoulder.”

Dix described the incident as a highly unusual occurrence.

“I’ve seriously never in the whole time I’ve been in law enforcement heard of this happening before. Someone getting a word in on someone. I’ve never seen it happen before and I’ve never heard of it,” he said. “That’s the issue that was at the forefront of my mind is that he shouldn’t have called the officer and told him to stop the car. He shouldn’t have approached the car. He shouldn’t have opened the door. The whole incident shouldn’t have happened, period. I think it was just he wanted to see him sitting in the back of the car and do the don’t challenge me thing. Don’t call me out. Keep my name out of your mouth. You’re going to jail. I think it was just an extremely poor decision and an extremely poor action that is a prime example of the confidence that we are trying to build not just here but across the country, how it puts that in jeopardy over an emotional decision that I believe everybody agrees should not have happened at all.”

In his statement to the GBI, Conner Dix confirmed Pitts called and told him to stop his vehicle and that he saw the superior officer open the back door of his patrol car. He stated he heard the ensuing verbal altercation and saw Pitts put his hand on Smith but said he did not see Pitts slam his head into the partition.

Relative to this incident, Conner Dix received a three-day unpaid suspension for turning off his body worn camera.

“He (Conner Dix) said they did it all the time; it wasn’t just in this particular incident. He said he looked down and saw that it was on, so he turned it off, but that doesn’t happen anymore. The policy is clear on that. You don’t turn it off,” Dix said, explaining that SCSO policy has been revised to state the use of body worn cameras may not be discontinued until prisoners have been transferred to jail personnel.

Josh Pitts has been hired by the Butts County Sheriff’s Office.

Pedestrian struck and killed late Monday night on South Hill Street

A pedestrian was struck and killed late Monday night when he was struck by a vehicle on South Hill Street.

Sgt. Robert Thompson, of the Georgia State Patrol-Griffin Post, said the incident was reported at approximately 11:19 p.m.

The victim, whose name has not been released pending notification of his next of kin, was pronounced dead at the scene.

Thompson said the victim was struck by a 2006 Chevrolet Tahoe that was travelling southbound. The collision happened approximately one-quarter mile north of the Hillandale subdivision in a curve in the roadway.

“According to the remarks (in the incident report), the pedestrian was in the roadway,” Thompson said.

The driver, 47-year-old Nicholas Flowers, of Thomaston, was not cited in the incident.
